These Terms of Service (“Terms”) govern your use of the Tricky Treats™ website, funnels, portals, and related digital properties (collectively, the “Website”), operated by Assisting Community with Transition and Service (ACTS) Consulting LLC - (ACTS Consulting LLC) here in afterA (“ACTS,” “we,” “us,” or “our”).
Tricky Treats™ is a proprietary program of ACTS Consulting, LLC.
By accessing or using this Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.
2. Nature of the Website
The Website provides:
Information regarding the Tricky Treats™ safety training system
Licensing and certification information
Access to controlled licensing portals
Lead capture and scheduling functionality
Training reporting forms
Access to authorized materials for certified trainers
This Website is not a retail marketplace.
All materials are licensed, not sold.
3. Intellectual Property Ownership
All content on this Website, including but not limited to:
Text
Graphics
Logos
Training materials
Slide decks
Downloadable resources
Program structure
Branding elements
The Tricky Treats™ name and system
are the exclusive property of ACTS Consulting, LLC and are protected by copyright and other intellectual property laws.
No ownership rights are transferred to users.
Access does not grant reproduction, modification, or distribution rights.
4. Licensing, Not Sale
Any purchase of access, certification, or materials through this Website constitutes a limited, revocable, non-transferable license.
You do not acquire ownership of:
Slide decks
Seminar materials
Curriculum materials
Certification status
Licenses are:
Individual
Non-transferable
Non-assignable
Non-sublicensable
Unauthorized sharing, duplication, or redistribution is strictly prohibited.
5. Certification & Authorization
Only ACTS Consulting, LLC may issue certification for Tricky Treats™ trainers.
Certification:
Is issued to individuals only
Expires annually
May be revoked for violation of terms
Master Trainers may not issue certification to others.
6. Restrictions on Use
Users may not:
Modify slide decks or materials
Remove or alter branding
Upload materials to shared drives
Distribute materials digitally
Photocopy or duplicate protected materials
Record and redistribute training sessions
Present materials without active certification
Any unauthorized use constitutes breach of these Terms.
7. District & Organization Purchases
If a district or organization funds a license:
The license remains assigned to the individual trainer
The district does not acquire ownership rights
Materials may not be transferred to other staff without certification
ACTS reserves the right to require re-certification for replacement trainers.
8. Reporting & Compliance
Certified trainers are required to:
Log trainings conducted
Report attendance numbers
Submit compliance data as required
Failure to comply may result in suspension or revocation of access.
ACTS retains training data for program integrity and quality control purposes.
9. Payment & Subscription Terms
Licenses and certifications may require annual subscription payments.
By purchasing a subscription, you agree that:
Fees are recurring annually unless cancelled
Failure to renew results in expiration
Access may be revoked upon non-payment
Refund policies, if applicable, are described at checkout.
10. Third-Party Services
The Website may integrate third-party services, including:
Payment processors
Membership platforms
Print fulfillment providers
Scheduling systems
ACTS is not responsible for third-party platform interruptions or errors.
11. No Guarantee of Results
Tricky Treats™ provides structured educational materials.
ACTS does not guarantee:
Specific institutional outcomes
Reduction of incidents
Regulatory compliance beyond materials provided
Implementation fidelity is the responsibility of the certified trainer and/or purchasing organization.
12. Limitation of Liability
To the fullest extent permitted by law, ACTS Consulting, LLC shall not be liable for:
Indirect damages
Consequential damages
Loss of data
Loss of revenue
Misuse of materials
Total liability shall not exceed the amount paid for the license in the preceding 12 months.
13. Enforcement & Termination
ACTS reserves the right to:
Suspend or revoke access
Terminate certification
Pursue legal remedies
for violations of these Terms.
Upon termination, access to all protected materials will cease immediately.
14. Governing Law
These Terms shall be governed by the laws of the State of Michigan.
Any disputes shall be resolved in the appropriate courts within Michigan.
15. Modifications
ACTS may update these Terms at any time.
Continued use of the Website after updates constitutes acceptance of revised Terms.
